Rokita Statement on House v. Burwell Ruling

Washington, D.C. – Rep. Rokita (IN-04) released the following statement after a federal judge for the United States District Court for the District of Columbia, ruled that the House of Representatives has standing to challenge one of President Obama’s unilateral changes to ObamaCare.

Time after time, the Obama Administration proves its complete disregard for our country’s Constitution by side-stepping Congress and pushing an agenda that is harmful to our nation.  The President cannot pick and choose which parts of the law to enforce. This ruling reinforces what the President disregards, that separation of powers is core to the foundation of our government and must be respected. 

“Every Member of Congress takes an oath to uphold and defend the Constitution.  It is our duty to conduct oversight of the Executive Branch and this lawsuit is one tool in our toolbox we can use. I will continue working with my colleagues in the House to fight against government overregulation and protect the greatest document ever written, the Constitution,” said Rep. Rokita.

Representative Rokita supported the House Resolution last year authorizing the House to file a civil lawsuit against the Obama Administration in federal court.

The Court ruled that “The House of Representatives has standing to pursue its allegations that the Secretaries of Health and Human Services and of the Treasury violated Article I, Section 9, Clause 7 of the Constitution when they spent public monies that were not appropriated by Congress.”
